Terms & Privacy
The application, content and services (‘the App’) are owned and operated by Enroute Tech Pty Ltd (ACN 670 736 562) (‘Enroute’, ‘the Supplier’, ‘us’, ‘we’, ‘our’).
By using or accessing the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions (‘T&C’s’).
If you do not agree to these T&C’s, please do not use the App.
All Services are accepted and handled in accordance with the conditions below, and you, the customer, accept these conditions by using the Services.
1. Governing Law
The Supplier manages the Services from within Australia.
These T&C’s are governed by the laws of the State of Victoria.
You and the Supplier agree to submit to the non-exclusive jurisdiction of the courts of Victoria.
Use of this App is for residents of Australia only, and users must be over 18 years of age.
The Service is not available for customers under 18 years of age.
2. Revisions to T&C’s
The Supplier may revise or amend these T&C’s at any time at our absolute discretion by posting revised terms.
You agree that if any portion of these T&C’s is found to be unenforceable, the remainder remains in full force and effect.
Any revisions are effective immediately.
By continuing to use the Service after any revision becomes effective, you agree to be bound by the revised T&C’s.
3. Copyright
The material on this App is protected by copyright under Australian law and international treaties.
Unless otherwise indicated, all rights in content, text, graphics, logos, icons, audio, and software are owned or controlled by the Supplier and its affiliates, licensors, and licensees.
4. Advertising & Links to Third-Party Websites
This App may contain information or links to third-party websites (‘linked sites’).
Such sites are not under the control of the Supplier, and we are not responsible for their contents.
Links are provided as a convenience only and do not imply endorsement.
You rely on such information entirely at your own risk.
5. Personal, Non-Commercial Use
You may download and print portions of this App for personal use only, provided you do not modify the content and retain copyright notices.
You must not exploit any materials on this App for commercial purposes without written permission.
6. Prohibited Conduct
You are not authorised to reproduce, download, communicate, or adapt content from this App without written permission.
No trademark used by the Supplier may be used without prior consent.
7. Licence to Use
You grant the Supplier an irrevocable, non-exclusive licence to use any material or ideas you transmit to this App.
You warrant that you own any data uploaded to the App and that you have the right to grant this licence.
8. User Conduct
You must not upload, post, or transmit material that violates the rights of others, is unlawful, defamatory, obscene, or interferes with the operation of the App.
You are responsible for keeping your login details secure and indemnify the Supplier against unauthorised use.
9. Indemnity
You agree to indemnify the Supplier against any claims, losses, or damages arising from your use of the App or your breach of these T&C’s.
You also agree to indemnify us from any liability related to your services or user content.
10. Our Service
The Supplier provides a platform facilitating roadside assistance through third-party mechanics (‘the Service’).
Mechanics who register agree to provide the Service under these terms in exchange for payment.
You must maintain an active account to use the App and hold current licences, insurances, and certifications.
The Supplier may suspend or deactivate accounts for breaches or safety concerns.
Mechanics acknowledge they are independent service providers, not employees.
Service fees, payments, and cancellations are governed by clauses 10.38–10.51.
11. Price
Prices include GST and are displayed in Australian Dollars.
Prices and availability may change without notice.
You are responsible for paying all applicable taxes.
12. Disclaimer
To the extent permitted by law, the Supplier is not liable for any direct or indirect losses arising from your use of the App, including service interruptions, errors, or user conduct.
You agree to bear all costs of necessary repairs to your devices arising from App use.
13. Liability
We exclude liability for Service Requests based on information on this App.
All limitation and indemnity clauses survive termination.
14. Disclaimer of Warranty
The App is provided “as is” and used at your own risk.
We make no warranty as to the accuracy or reliability of information or linked sites.
We disclaim all implied warranties of merchantability or fitness for purpose.
15. Rights We Cannot Exclude
Nothing in these terms excludes any rights under the Competition and Consumer Act 2010 (Cth) or other applicable law.
16. Termination
Access to the App may be terminated by the Supplier at any time without notice.
All restrictions and limitations of liability survive termination.
17. Frustration (Force Majeure)
The Supplier will not be liable for failure to perform due to events beyond its control, including strikes, accidents, natural disasters, or war.
Performance will be suspended for the duration of such events.
18. Privacy
The Supplier complies with the Privacy Act 1988 (Cth).
Personal information may be collected when you use the App or contact us.
We use this information to provide services, manage customer relationships, and comply with legal obligations.
Your data may be shared with third parties where necessary to provide services, comply with law, or with your consent.
You may opt out of marketing communications by emailing service@enroute-tech.com.
We take reasonable steps to protect personal information and will destroy it when no longer required.

19. Location Data Usage
The App requires access to your device's location services to enable real-time service monitoring and tracking of mechanic locations during active service requests.
Purpose: Location data is used solely for operational purposes, including:
- Real-time display of your location to workshop managers for logistics monitoring
- Real-time display of your location to drivers who have requested your service
- Route optimisation and estimated arrival time calculations
- Service delivery coordination and logistics monitoring
No Storage: Location data is transmitted and displayed in real-time only and is not stored on our servers or databases. Once a service request is completed or cancelled, location tracking ceases immediately.
User Control: You may disable location services at any time through your device settings, however this may impact the functionality of the Service and our ability to provide accurate service updates to workshop managers and drivers.
Security: Location data transmitted through the App is encrypted and protected during transmission using industry-standard security protocols.
Third-Party Access: Real-time location information is only shared with workshop managers monitoring service delivery and drivers who have requested your service. No location data is sold or shared with third parties for marketing purposes.
By using the App, you consent to this use of location data for the purposes outlined above.
20. General
19.1 Dispute Resolution
Any disputes that cannot be resolved by negotiation will be referred to arbitration under the Resolution Institute Arbitration Rules.
19.2 No Assignment
You may not assign or transfer any rights or obligations under these terms without written consent.
19.3 Entire Understanding
These terms constitute the entire agreement between you and the Supplier and supersede all prior agreements.
19.4 Waiver
Failure by the Supplier to enforce any right does not constitute a waiver.
Any waiver must be in writing and signed by both parties.
